Osun Guber Poll: Supreme Court hears case of Adeleke, Oyetola Tuesday

Supreme court to rule over Oyetola and Adeleke

The Supreme Court of Nigeria has scheduled judgment for an appeal filed by former Osun Governor, Gboyega Oyetola against the election of the incumbent Governor Ademola Adeleke for Tuesday by 2pm

Adeleke of the Peoples Democratic Party, PDP, was declared the winner by the Independent National Electoral Commission, INEC but his victory was challenged at a tribunal led by Justice Tertse Kume sitting in Osogbo.

Adegboyega Oyetola of the All Progressives Congress, APC, was pronounced duly-elected governor against the declaration of INEC.

However, the Appeal Court, in a judgment by Justice Mohammed Shaibu on March 24, 2023, declared Adeleke the authentic winner.

INN gathered that the apex court will today hear the appeal filed by Oyetola against the victory of Adeleke.

Adeleke and PDP are cross-appealing the decision of the Court of Appeal, aligning the Certified True Copy, the legitimacy of the Bimodal Voter Accreditation System, BVAS, relied upon by the APC, and the date on the certified true copy.

They are also cross-appealing the issue of the co-authorship of the judgment and the validity of the tribunal judgment.

In the meantime, Justice Haruna Tsammani-led’s five-member panel of the Presidential Election Petition Court (PEPC) has also announced that it would commence its pre-hearing session today with three petitions.

He said the court has scheduled a hearing on the other two petitions by Allied Peoples Movement (APM) marked: CA/PEPC/04/2023, and Atiku Abubakar & the Peoples Democratic Party (PDP) marked: CA/PEPC/05/2023 for Tuesday
